我国图书馆适用合理使用制度之困境与对策研究

Research on the Dilemma and Solution of Fair Use System Applicable to Libraries in China

文章基于我国图书馆适用合理使用制度的现状,分析图书馆适用合理使用制度面临的困境及其成因,进而提出构建以图书馆使用者权为重心的合理使用制度、将现行法定合理使用情形平行延伸至数字环境、提升图书馆规范适用合理使用制度的法律意识等破解我国图书馆合理使用适用困境之对策。

Based on the situation of Chinese libraries applying fair use system, the paper analyzes the dilemma and reason of fair use system applicable to libraries, and offers suggestions of solving the dilemma of fair use applicable to libraries in China, such as establishing the fair use system which focuses on library user rights, extending the current fair use situation to digital environment in parallel, enhancing the legal awareness of libraries applying fair use application normatively, ect.
