大数据的时代特征与法律认知

Era Characteristics and Legal Cognition of Big Data

在数字化时代浪潮和需求牵引下,“大数据”吸引了众多领域和公众的极大关注。如何理解大数据,如何发挥大数据的价值与功能,如何面对大数据的负面影响给人们带来的较大困惑,是大数据以及法律等领域亟待解决的问题。从大数据基本内涵、多元化特征、研究范畴、隐私与法律属性等方面,对大数据的科学意义、社会性质、大数据益处与风险的关系进行了论述。研究表明,大数据在给人们生活提供了方便、给社会各个领域增添解决问题的动力、促进社会进步的同时,一些负面影响会产生相关的法律问题。因此,以法律认知作为基本框架进行研究,对有效发挥大数据的价值与作用,有针对性地降低安全风险等负面影响具有重要意义。

Under the trend of digital era and demand traction,“big data”has attracted great attention from many fields and the public.How to understand big data,how to give full play to the value and function of big data,and how to face the big confusion caused by the negative impact of big data are urgent problems to be solved in big data and legal fields.This paper discusses the scientific significance and social nature of big data and the legal relationship between the benefits and risks of big data from the aspects of the basic connotation,diversified characteristics,research scope,privacy and legal attributes of big data.Studies have shown that while big data provides convenience to people's lives,adds motivation to solve problems in all areas of society,and promotes social progress,some negative effects will produce related legal issues.Therefore,research with legal cognition as the basic framework is of great significance for effectively exerting the value and role of big data and reducing negative impacts such as security risks in a targeted manner.
