家庭暴力告诫制度适用研究

Research on the Application of the Warning System of Domestic Violence

家庭暴力告诫制度作为我国反家庭暴力历程中的一大制度亮点,发挥着证据作用、教育作用和震慑作用,是公安机关干预家庭暴力的重要抓手。目前家庭暴力告诫制度的实施仍存在执法民警认识模糊、法律规定相对笼统、社会大众认识偏差等不足,对此提出提升公安机关的干预效度、完善家庭暴力的法律法规、构建社会联动的工作机制等建议,以实现对家庭暴力的有效防止,实现家庭和睦与社会和谐。

As a bright spot in the process of anti-domestic violence in China,the warning system of domestic violence,which plays the role of evidence,education and deterrence,is an important starting point for the public security organs to intervene in domestic violence.At present,the implementation of this system still exists some shortcomings:obscure understanding of the police,general regulations of the law,biased awareness of the public and so on.In view of these problems,this article makes the following suggestions:promote the validity of the police’s intervention,improve the laws and regulations of domestic violence,build the social linkage mechanism and so on,in order to prevent the domestic violence effectively,realize the harmony of family and society.
