量刑规范化改革的完善进路

量刑规范化改革是我国司法改革的重要组成部分,界定其含义与目标,对量刑规范化的实现具有重要意义。自最高人民法院颁布《关于常见犯罪的量刑指导意见》后,我国司法审判中的量刑方式从“估堆式”逐渐转变为“规范化量刑”。在“规范化量刑”的实施过程中,量刑基准的确定是量刑规范的基础,避免犯罪事实重复评价和增强疑难案件的可操作性是规范化改革的重点,为了克服规范化量刑弊端,可以通过促进“量刑均衡”、引入智慧量刑系统予以解决。
