情境预防理论在电信网络诈骗犯罪治理中的适用

电信网络诈骗犯罪由于呈现出的专业性、高收益性、隐秘性和涉众性,导致传统的司法预防和社会预防难以适应当前严峻的新型诈骗犯罪治理形势。而情境预防作为与司法预防、社会预防三足鼎立的预防方式,其完全符合电信网络诈骗犯罪防范的需要,并且能够弥补传统预防方式的不足之处,更为灵活地应对新型诈骗犯罪,具备运用情境预防治理电信网络诈骗犯罪的必要性和可行性。从情境预防25种技术手段出发,选择出适合治理电信网络诈骗犯罪的情境预防手段,希望能与司法预防和社会预防相结合,构建全面的预防体系,减少电信网络诈骗犯罪的发生。

The traditional judicial prevention and social prevention approaches have trouble catering to the governance of new kind of fraud due to its professionalism,high profit,secrecy and large population involved.However,the situational prevention as well as judicial prevention and social prevention,which are three important prevention approaches,can fully satisfy the needs of the telecoms fraud prevention,and can complement the shortcomings of traditional prevention methods because it is more flexible,necessary and feasible in preventing and governing telecoms fraud.Starting with 25 technical means,this paper has selected appropriate ways to prevent this crime,hoping it can be combined with social prevention approach and judicial prevention approach to form a comprehensive prevention system so as to reduce the incidence rate of the crime.
