党内法规监督规定的结构性分析及其提升路径

Structural Analysis of Inner-Party Regulations and Supervision Regulations and Its Improment Path

党内法规监督规定是党内法规制度体系的重要内容,也是党内法规有效执行的重要保证。现行党内法规监督主体设计模式分为同一模式、分离模式和协作模式,遵循“谁主管、谁负责、谁监督”原则及“统分结合、各司其职,一级抓一级、层层抓落实”的要求。党内法规监督方式分为报告式、评议式、督导式和巡视式,这些方式散见于不同党内法规。党内法规监督规定的规范性和操作性存在不足,党内法规监督的独立性和严肃性亦有不足。推动完善党内法规监督规定体系,重点在于党内法规监督与党内监督相融合,实现主体责任与监督责任的统一,提升结果运用的权威性;党内法规监督与党内法规评估相衔接,采用党内法规评估标准和方式,减少党内法规监督的命令性色彩,提升党内法规监督的精准度和权威性。

Inner-party regulations and supervision is an important part of the inner-party rules system and an important guarantee for the effective implementation of inner-party rules.Based on the analysis of some existing inner-party rules,the design mode of inner-party rules supervision can be divided into the same-mode,the separation-mode and the cooperation-mode,following the principle of“who is in charge,who is responsible,who supervises”and the requirements of“unification and division,each performing its own duties,one level grasping one level,each level grasping implementation”.The supervision types of inner-party rules can be divided into report-type,review-type,supervision-type and patrol-type.At present,the standardization and operation of the supervision of inner-party rules are insufficient,and the independence of the supervision are insufficient.To promote regulation system for inner-party rules supervision,the focus is on the integration of supervision of inner-party rules with inner-party supervision,and the unification of the main body of responsibility and supervision responsibility.Inner-party rules supervision should be linked with evaluation,and evaluation methods should be adopted to reduce the mandatory nature of supervision,and improve the accuracy and authority of supervision.
