摘要
平台用工劳动基准旨在形成平台经济下灵活就业从业者的基本劳动条件。当前政策组合中的劳动基准规范属于雇主义务型劳动基准,以《最低工资规定》中的“正常劳动”和“劳动定额”为工具,试图将基于从属性劳动的劳动基准构造适用于平台用工。但平台用工因灵活性与自主性已突破“劳动过程受拘束”的劳动形态及劳动基准的雇主义务法理,形成承揽合同社会化的新形态,应探索基于经济从属性的任务计量型劳动基准,控制承揽任务单价、连续性和总量,并建立算法知情与集体同意规则,在劳动基准立法中采取“独立专章”的制度建构路径,在劳动条件领域推动劳动二分法向三分法转型。
The working standards for the platform work aim to form the basic working conditions for flexible job-taking workers in the platform economy.The rules on working standards in the current policy portfolio are employer-obligatory ones,using"normal working"and"working quota"in the Regulation on Minimum Wage as tools with attempts to apply the structure of working standards based on subordinate labor to platform work.However,the platform work,due to its flexibility and autonomy,has broken through the labor form of"labor process being bound"and the jurisprudence of employer’s obligation of working standards,thus establishing a new form of socialization of contract of work,so it is necessary to explore the task-measurement working standards based on economic subordination,control the unit price,continuity and total amount of work-contracting tasks,and establish the rules of informed algorithm and collective consent,and adopt the approach of system establishment by setting a"separate chapter"in the legislation on the working standards,and promote the transformation of working dichotomy to working trichotomy in the field of working conditions.
