论环境法典的“行政领域立法”属性

On Attribute of "Administrative Field Legislation" of Environmental Code

全国人大常委会将环境法典确定为“行政立法领域的法典编纂”,需要正确把握环境法典的属性。生态文明入宪、生态文明体制改革的迅速推进、生态环境综合执法现状对认识环境法典的“行政立法领域”属性提出需求。从中国特色社会主义国家目的、国家目标、国家任务不断发展和国家治理体系不断演进的过程中,可以发现环境法典的“行政领域立法”属性的涵义。以此为基础,通过完善法律体系分类方法,明确环境法典“领域型”特性,提出环境法典编纂方案。

Environmental Code is positioned as ’’codification in administrative law field" by the Standing Committee of the National People’s Congress in China.All the considerations of the constitutional integration of ecological civilization conception,the rapid advancement of the systematic reform of ecological civilization and the status quo of comprehensive law enforcement of ecological environment in the background of Socialism with Chinese characteristics demand for recognizing the attribute of "administrative legislation field" of Environmental Code.In the process of the development of national purposes,objectives,tasks and governance,the meaning of the attribute of "legislation in administrative field" of Environmental Code can be identified.On this basis,the compilation plan of Environmental Code is proposed by means of improving the classification of the legal system and making clear the domain of environmental code.
