监察委移送起诉案件补充调查程序的缺陷及其完善

由于程序的“回流”本就属于正常程序的异常安置,因此补充调查程序是最能体现监察调查与审查起诉程序衔接是否顺畅的制度。在对检察机关审查起诉退回补充侦查机制的实践运行过程中存在的问题进行反思的基础上,充分考虑监察调查程序的特殊性,为监察委移送起诉案件补充调查程序的完善与优化提供思考方向,以推进我国监察调查程序与诉讼程序的有效衔接。

Since the“return”of the cases in the procedures belongs to the abnormal placement of the normal procedure,the supplementary investigation procedure can best reflect whether the connection between the supervisory investigation and the review and prosecution procedure is smooth.On the basis of reflecting on the problems existing in the operation of the mechanism of procuratorial review of the prosecution and the dismissal of the case for supplementary investigation,this paper fully considers the particularity of the supervision and investigation procedures,and provides the direction for the improvement and optimization of the supplementary investigation procedure of the cases transferred by the Supervisory Commission,so as to promote the effective connection between the supervision,investigation and litigation procedures in China.
