刑事庭审实质化视角下庭前会议制度研究

Research on the Pretrial Conference System under the Perspective of the Substantiation of Criminal Trial

庭前会议制度的基本功能是解决可能导致庭审中断的程序性事项,保障庭审集中、高效进行。庭前会议功能的有效发挥,一方面可以使庭审进程更加流畅,避免因程序性事项中断庭审造成的诉讼拖延,充分体现庭审实质化对于集中审理的要求;另一方面,法官可以通过庭前会议有效掌握庭审的重点,将主要庭审资源用于争议较大的事实问题、法律问题的解决,在司法资源相对紧张的情况下,有助于实现有效的庭审对抗、实质化的法庭审理。通过刑事庭审实质化的视角分析庭前会议制度的制度内涵和现实样态可以看到,当前庭前会议制度在司法实践中呈现出形式化与庭审化两种偏离倾向。充分发挥庭前会议制度的功能需要明确庭前会议制度的功能定位,完善庭前会议程序设置,厘清庭前会议的效力,强化被告人权利保障机制。

The basic function of the pretrial conference system is to solve the procedural matters that may lead to the interruption of the court trial,and ensure the centralization and efficiency of the court trial.The function of pretrial conference,on the one hand,can make the trial process more efficient,avoid the litigation delay caused by the interruption of the trial due to procedural matters,and fully meet the requirements of the substantiation of the trial for centralized trial.On the other hand,the judge can effectively master the core issues of the trial through the pretrial conference,and use the main resources for the settlement of controversial factual and legal issues.Considering the shortage of judicial resources,pretrial conference helps to achieve effective court trial confrontation,substantive court trials,and improve the quality and efficiency of trials.By analyzing the pretrial conference system from the perspective of the substantiation of criminal trial,a conclusion can be drawn that the pretrial conference system shows two deviation tendencies of formalization and substantiation in judicial practice.To give full play to the function of the pretrial conference system,we need to clarify the function and effectiveness of the pretrial conference system,improve the pretrial conference procedure,and strengthen the protection of the defendant’s rights.
