On the Distinction between Inner-Party Regulations and the Party’s Normative Documents

实现党内法规与党的规范性文件的区分是坚持依规治党的必然要求。从关系上看,党内法规与党的规范性文件特殊与一般的关系使得党内法规的“特殊规范性”与党的规范性文件的“一般规范性”之间得以保持一定距离。按照新修订的《中国共产党党内法规制定条例》所确立的制度框架,党内法规与党的规范性文件事实上建构起形式与实体相结合的“双重区分标准”,即强调两者在形式规范性与实体规范性上存在明显区别。但问题似乎不止于此。当下党内法规与党的规范性文件的区分面临文件造规的“合规性”诘问,可以考虑通过解构党内法规体系、明确党的中央组织制定的规范性文件的特殊性,以及经由党中央授权制定的方式等路径来予以消解。

The distinction between the inner-Party regulationsand the Party’s normative documents is an inevitable requirement for governing the Party through regulations.From the perspective of relationship,the special and general relationship between the inner-Party regulations and the Party’s normative documents keeps a certain distance between the“special normalization”of the inner-Party regulations and the“general normalization”of the Party’s normative documents.According to the institutional framework established in the newly revised regulations on the formulation of inner-Party regulations,the distinction between the innerParty regulations and the Party’s normative documents has actually constructed a“double standard”of the combination of form and substance,that is,to emphasize the obvious difference in the formal normalization and the substantive normalization.But the problem seems to be more than that.The current distinction between the inner-Party regulations and the Party’s normative documents is confronted with the question of“compliance”of file made rules.It can be resolved by deconstructing the system of inner-Party regulations,clarifying the particularity of the normative documents formulated by the central organization of the Party,andadopting the ways authorized legislation by the central organization of the Party.
