论党内法规合理性审查标准的展开

The Development of the Standards for Reviewing the Reasonableness of Inner-Party Rules and Regulations

党内法规的合理性审查标准具有维护党内法规理性权威、保障党员正当权利、衔接合法合规性审查以及规范自由裁量等实践价值。目前的合理性审查标准面临审查内容不确定、“不合理”情形的列举缺乏涵盖性与周延性、实用性薄弱等困境,制约着合理性审查制度的发展。应当在习近平新时代中国特色社会主义思想的指引下,借鉴和转化公法上的比例原则,从目的正当性、手段选择最优、目的与手段之间比例均衡三个层次构建合理性审查基准,以期更好地适应新时代的法治建设目标以及完善党内法规制定和监督制度的要求。

The standards for reviewing the reasonableness of inner-party rules and regulations have the practical value of maintaining the rational authority of inner-party laws and regulations, protecting the legitimate rights of Party members, connecting the legal compliance review and regulating the discretion.At present, the standards of rationality review are faced with the difficulties of uncertain content, lack of coverage and comprehensiveness, and weak practicability, which restrict the development of rationality review system.Under the guidance of Xi Jinping’s thought of socialism with Chinese characteristics for a new era,we should learn from and transform the principle of proportionality in public law.This paper constructs the benchmark of rationality review from three levels: the legitimacy of purpose, the best choice of means, and the balance of proportion between purposes and means, in order to better adapt to the goal of the rule of law in the new era and improve the requirements of the regulations and supervision system within the party.
