Investigation and Punishment to a Case of Operating Pig Products Unaccompanied by Quarantine Marks

2021年10月,海南省某综合行政执法局在监督检查时,发现当事人涉嫌经营未加施检疫标志的猪产品。经立案调查,认定当事人违法事实存在,依法并给予了行政处罚。本文介绍了案件的发生经过、查处取证、法律适用及处理情况等执法内容,重点讨论了案件中涉及的动物检疫证章标志的关系、查封扣押与登记保存的适用、听证制度的执行和私自处置查封扣押物品的应对等问题,指出了畜牧兽医行政执法中的相关重(难)点和关键环节,以期为行政执法人员办理同类案件提供参考。

In October 2021,an operator was found to be suspected of operating pig products unaccompanied by quarantine marks by a comprehensive administrative law enforcement bureau in Hainan Province during its routine supervision and inspection.As it was investigated,the illegal facts made by the party concerned was confirmed,who was then administratively punished according to relevant law.In the paper,the occurrence and process of the case,investigation and evidence collection,law application,handling and other relevant information were introduced,with a priority on the issues including the relationgship between the animal quarantine certificates and seals involved in the case,application of seizure,detention and keeping of registration,implementation of the hearing system and the response to any private disposal of seized and detained items,then the key points(difficulties)and links during the administrative law enforcement of animal husbandry and veterinary medicine were pointed out,aiming to provide a reference for administrative law enforcement personnel to handle similar cases.
