Legal Considerations on Human Organ Donation and Transplantation in China——Taking "Fake Organ Donation" as Breakthrough Point

从捐献决定的效力、捐献履行程序、捐献移植时间、医师涉罪问题四个角度分析“器官假捐”案,整理归纳目前我国器官捐献与移植现状,提出完善我国器官捐献与移植体系的相关建议。

This paper analyzes the cases of "false organ donation" from the following perspectives: the effectiveness of donation decision, the procedure of donation fulfillment, the time of donation and transplantation, and physicians’ involvement in committing crimes, summarizes the current situation of organ donation and transplantation in China and proposes suggestions on improving organ donation and transplantation system.
