摘要
苏区司法中形成的裁判类法律史料,是红色司法案例的重要载体,广泛留存于《红色中华》《裁判汇刊》等历史文献中。整理与研究苏区司法案例,需要引入史源学方法,多方对比、查验与勘误;要辨析史料属性、典型性,以历史唯物主义来分析评判。苏区司法案例中反映出的求真、平等与公正,构成了人民司法传统与社会主义法治精神的历史渊源,其现实价值需要珍视。
The judicial legal historical materials in the Soviet area formed in the judicature of the Soviet Area were important carriers of red judicial cases,which were widely preserved in historical documents such as Red China and the Journal of Judicial Proceedings.In order to sort out and study the judicial cases in the Soviet area,we need to introduce the method of historical genesis,multi-party comparison,inspection and correction;It was necessary to distinguish the attribute and typicality of historical materials,and analyze and judge them with historical materialism.The truth-seeking,equality and justice reflected in the judicial cases in the Soviet area constitute the historical origin of the people’s judicial tradition and the socialist spirit of rule of law,and its practical value need to be cherished.
