粤港澳大湾区法治深度协同的构想与进路

Conception and Approach of Deep Coordination of Rule of Law in Guangdong-Hong Kong-Macao Greater Bay Area

粤港澳大湾区一体化建设需以大湾区法治协同建设为基础,当前大湾区法治协同存在跨区域公共事务难以规制、多法域间制度容易产生冲突、区域法治协同不均衡不充分等问题。为推进大湾区法治深度协同发展,应当坚持系统治理的方法,明确以法治协同的原则、理念和协同机制为主要内容的总体构想,并确定适当的落实路径,具体而言,应通过“央地联动”为大湾区法治深度协同构建有效制度基础,在此基础上以行政合作、司法合作、社会合作为具体实施进路,促进执行层面协同与融合。

Guangdong-Hong Kong-Macao Greater Bay Area s integration needs to be based on the coordinated construction of rule of law in this area.At present,there are some problems in the coordination of rule of law in Greater Bay Area,such as the difficulty in regulating cross-regional public affairs,the conflicts of systems among different jurisdictions,and the imbalance and insufficiency of regional coordination of rule of law.In order to promote the deep coordination of rule of law in Greater Bay Area,it is desirable to adhere to the method of systematic governance,define the overall conception with the principle,concept and coordination mechanism of rule of law as the main content,and determine the appropriate implementation path.Specifically,it is desirable to build an effective institutional foundation for the deep coordination of rule of law in Greater Bay Area through“central-local reaction”,and on this basis,take administrative cooperation,judicial cooperation and social cooperation as the concrete implementation approaches to promote coordination and integration at the executive level.
