论人脸识别技术应用的隐私安全风险与法律规制

On the privacy and security risks and legal regulations of the application of face recognition technology

探析人脸识别技术应用引发的隐私安全风险,讨论我国隐私保护理论亟待优化的问题。基于人脸识别技术的具体应用场景下的隐私安全风险进行实证考察,发现我国人脸识别技术的隐私安全法律风险主要存在于人脸模式识别过程与识别应用系统中。对我国以及域外人脸识别技术相关法律规制进行文献考察及比较分析后得出以下结论:我国对人脸识别技术的规制应当重点关注规制主体、规制对象、技术保护以及法律责任等方面。具体而言,实现人脸识别技术应用与个人信息保护之间平衡,在法律层面应明确限定人脸识别技术的应用场景,同时优化民法、刑法、行政法三位一体的司法保护。

The widespread application of face recognition technology has caused privacy and security risks,which arise the heat discussions of optimizing privacy protection theory.This paper conducts an empirical investigation on the privacy security risks of face recognition technology in specific application scenarios,and finds that the privacy security legal risks of face recognition technology mainly exist in the face pattern recognition process and recognition application system.Through the literature review and comparative analysis of the legal regulations related to face recognition technology at home and abroad,it is concluded that the regulation of face recognition technology should focus on the subject of regulation,the object of regulation,technical protection and legal responsibility.Specifically,to effectively achieve the balance between the application of face recognition technology and the protection of personal information,the application scenarios of face recognition technology should be strictly limited in law,and the judicial protection in the aspect of civil law,criminal law and administrative law should be optimized.
