数字鸿沟背景下老年人数字化生活权的权利证成和法治保障——基于哈勒尔权利证成的视角

Justification and Legal Protection of the Elderly’s Right to Digital Life under the Background of Digital Divide:Based on Alon Harel’s Theory of Rights

作为一项新兴权利,老年人数字化生活权是以机会均等和过程公平原则为基点,向实现公平、正义、安全等数字需求发展,从而确保老年群体享有过上个性、便捷、安全的数字化生活的权利。文章从哈勒尔的权利证成视角入手,通过内外双重视阈对老年人数字化生活权进行权利证成。人性尊严之彰显作为内在理由,可以独立证成老年人数字化生活权;而当代中国语境下的“共同善”作为外在理由,强化老年人数字化生活权保护的重要性。技术化叠加老龄化背景下,数字鸿沟在代际之间进一步扩大,应当重视老年群体在数字时代的边缘地位,从倡导人本理念、强化法制支撑、寻求社会合力等方面探索保护老年人数字化生活权的路径。

As an emerging right,the elderly’s right to digital life is based on the principle of equal opportunities and fair process,and it is developing towards the realization of digital needs such as fairness,justice and security,so as to ensure that the elderly people enjoy the right to live a personalized,convenient and safe digital life.Based on Alon Harel’s theory of rights,the justification of the elderly’s right to digital life is carried out through both internal and external attentions.The display of human dignity as the internal reason can independently justify the digital life right of the elderly,while the“common good”in contemporary Chinese context as the external reason strengthens the importance of protecting the digital life right of the elderly.Under the background of the superposition of technicalization and aging,the digital divide is further widening between generations.We should pay attention to the marginal status of the elderly in the digital age,and explore ways to protect the digital life right of the elderly from the aspects of advocating people-oriented concept,strengthening legal support and seeking social synergy.
