社会主义法治“信仰”的演进理路与生成逻辑

Evolutionary Route and Generative Logic of"Belief"in the Socialist Rule of Law

以党的十一届三中全会为起点,中国特色社会主义法治经历了三次法治目标的飞跃。“法律信仰—法治信仰—社会主义法治信仰”的演进理路反映了我国社会主义法治道路建设过程中从现代国家建构到普遍法治建设再到社会主义法治道路建设进程中国家经验积累和政治认同的结果。法律信仰体现了现代国家建构中国家规范的核心地位,法治信仰从价值维度、目标维度和实践维度三方面对法律信仰实现了超越,社会主义法治信仰以马克思主义法学中国化的理论逻辑、文化传统和文化自觉的历史逻辑以及坚持党的领导的实践逻辑来构建,符合中国特色社会主义法治国家和社会共同体的价值取向和未来期待。

Starting from the Third Plenary Session of the Eleventh Central Committee,the socialist rule of law with Chinese characteristics has experienced three leaps in the goal of rule of law.The historical evolution of"Legal Belief-Belief in the Rule of Law-Belief in the Socialist Rule of Law"reflects the country’s national experience and political identity in the process of building a socialist rule of law from a modern country to a general rule of law to the socialist rule of law.Legal belief as a choice during the construction of the legal system conforms to the social expectation that the state’s enactment of laws is the basis for citizens to obey the law.As a choice in the new stage of rule of law,the belief in law has surpassed legal belief in three aspects:value,goal and practice.The socialist belief in the rule of law has Chinese characteristics and political attributes in terms of theoretical traditions,practical foundations,and fundamental guarantees,and conforms to the value orientation and future expectations of a socialist country under the rule of law and a social community with Chinese characteristics.
