生态文明视域下新《森林法》基本原则与制度建构

The Basic Principles and System Construction of the New Forestry Law from the Perspective of Ecological Civilization

从习近平生态文明思想的立法实践出发,探讨新《森林法》确立的生态安全、和谐共生、可持续发展的价值目标,据此分析新《森林法》中生态优先、保护优先、保育结合、可持续发展基本原则的内涵,进而论证这一原则主要通过森林资源保护制度、森林资源经营管理制度及森林资源永续利用制度来实现。

This article starts from the legislative practice of Xi Jinping’s thoughts of ecological civilization,discusses the values of ecological safety,harmony between human and nature and sustainable development established by the newly amended Forestry Law,and then analyzes the fundamental principles of giving priority to ecology and protection,combining reservation and protection as well as the sustainable development contained therein.This article further demonstrates that the aforementioned principles are mainly realized via the implementation of forestry resources protection systems,forestry resources operation and management systems and forestry resources sustainable exploitation systems.
