在线庭审是电子诉讼的中心环节,其在疫情常态化背景下体现出时代价值。目前在线庭审除了体现效率价值外,也逐步体现出适用范围不清、庭审实质化被削弱和当事人权利受影响的问题。结合实际和域外经验,通过确立选择性适用范围、完善在线庭审场所限制机制和完善当事人和法院二元程序选择机制的路径方法,以期完善在线庭审模式。

Online court hearing is the central link of electronic litigation, which plays an important role in the context of the normalization of the epidemic. At present, online court hearings not only reflect the efficiency value, but also gradually reflect the unclear scope of application, trial substantive is weakened and the rights of the parties affected. Combined with the practice and overseas experience, this paper tries to perfect the online trial mode by establishing the selective scope of application, perfecting the restriction mechanism of online trial site and the path method of perfecting the binary procedure selection mechanism of litigant and court.
