RCEP助推中国数字经济高质量发展的对策研究

Resarch on the Countermeasures of RCEP to Promote the High-Quality Development of China's Digital Economy

《区域全面经济伙伴关系协定》(RCEP)作为目前全球最大的自由贸易协定,在成员国跨境电子商务、区域贸易合作、数据和知识产权保护等方面均做出了规定,有助于优化要素资源配置,加速产业链、价值链升级,促进国际贸易紧密协作,为数字经济的发展提供了新机遇。文章以“机制分析—风险研判—对策建议”的思路展开研究:首先,从数字产业双循环、数字经济空间协同、数字关税保障三个维度分析了RCEP促进数字产业发展的内在机制,探寻了RCEP协议条款与数字经济高质量发展间的契合性;其次,从协定数字规则设定立意、缔约方国内知识产权立法背景、协定数字监管与协调效能、外部环境四个层面解读了数字规则,剖析了RECP为中国数字经济高质量发展带来的挑战;最后,提出了借助RCEP实现中国数字经济高质量发展的对策建议。

As the largest free trade agreement in the world at present,the Regional Comprehensive Economic Partnership(RCEP)has made provisions in the cross-border e-commerce,regional trade cooperation,data and intellectual property protection,which provides new opportunities for the digital economy development to optimize factor resource allocation,accelerate the upgrading of industrial chains and value chains,and promote close collaboration in international trade.This research follows the logic of“analyzing mechanism-predicting challenge-offering suggestions”.Firstly,analyzes the mechanism of RCEP in promoting the development of digital industry from three dimensions,which are dual-circulation of digital industry,spatial cooperation of digital economy and digital tariff guarantee,and explore the compatibility between the provisions of RCEP agreement and the high-quality development of digital economy.Secondly,interprets the digital rules and analyzes the challenges that RCEP brings to the high-quality development of China's digital economy from four levels:the intention of digital rules,domestic knowledge legislation background of the parties,the effectiveness of digital regulation and coordination in the agreement,and the external environment.Finally,puts forward suggestions on how to realize high-quality development of China's digital economy with RCEP.
