防止耕地“非粮化”的法律规制研究

Research on the Rule of Legal Regulation to Prevent“Non-grain”of Cultivated Land

研究目的:分析“非粮化”现象的形成逻辑,确立法律规制理念,提出完善相应法律制度的路径。研究方法:法律文本分析、法律规范解释。研究结果:(1)我国当前“非粮化”现象体现出国家耕地保护政策目标与种植主体经营权之间的矛盾;(2)当前耕地保护立法与中央政策中防止“非粮化”的要求不适配,缺乏明确可操作的法律保障制度;(3)“非粮化”现象本质上是市场失灵的表现,可采用经济法中的国家干预理论予以治理,以实现市场系统与政府系统资源的有效配置。研究结论:防止“非粮化”的法律制度构建应当以国家干预理论为核心,以赋权、限权、激励的设计思路为导向,最终实现兼顾保障农民收益与国家粮食安全目标的效果。

The purposes of this study are to analyze the formation logic of“non-grain”of cultivated land,to establish the concept of legal regulation and to propose the path of improving relevant regulations.The research methods include legal text analysis and legal norm interpretation.The research results are:(1)the current“non-grain”phenomenon reflects the contradiction between the national policy objectives and the management rights of planting entities;(2)the current legislation of cultivated land protection policy does not match the requirement of preventing“non-grain”in the central policy,without clear and operational legal guarantee system;(3)the phenomenon of“non-grain”is essentially the manifestation of market failure,which can be governed by the theory of state intervention in the economic law,so as to realize the effective resource allocation of market and government systems.In conclusion,the construction of legal system to prevent“non-grain”should take the theory of state intervention as the core,and be guided by the design ideas of empowering,limiting and encouraging,so as to realize the effectiveness of guaranteeing both farmers’income and national food security.
