民行刑共治视野下高空抛物行为法律治理的逻辑回归

从传统的民事治理到刑事治理,再到被单独归罪,高空抛物行为的法律治理方式不断演变。为了优化相关法律治理社会的效果,应当进一步优化各个部门法之间的衔接,站在“民行刑共治”“民进刑退”的立场上,通过加强民事法律责任追究和明确高空抛物行为的行政管理法规的方式来补强行政犯天然“法益性欠缺”的本质。刑法应当回归传统的严谨和谦抑,避免未来轻罪入罪化的趋势。从立法层面到司法层面的跨越上理顺高空抛物行为法律治理的逻辑,促进民行刑法律体系的协调,提升社会治理能力和效果,对引导刑事立法的价值取向具有重要的理论和现实意义。
