Analysis and Reflection on Policies and Regulations of Personal Healthcare Data Rights and Interests

目的 研究个人健康医疗数据权益政策及相关问题,促进个人健康医疗数据共享和应用的合规性。方法基于文本内容分析法梳理个人健康医疗数据权益的含义,分析有关政策法规。结果 个人健康医疗信息权益包括知情权、自决权、查阅/查询权、复制/下载权、更正权、删除权、隐私权等,个人健康医疗数据的权利及保护的实施规定、要求等,散在于各种法规和政策文件中,完整的政策体系构建有待加强。结论 可基于个人健康医疗数据权益角度构建促进健康医疗数据共享与应用的政策体系,有助于厘清各方责权利,保护患者信息权益。

Objective This article aims to study the policies of rights and interests of personal healthcare data and related issues,and promote the compliance of personal health care data sharing and application.Methods Based on the text content analysis,the meaning of personal healthcare data rights was sorted out,and the related policies and regulations were analyzed.Results Personal Healthcare data rights include the right to know,the right to self-determination,the right to consult/inquire,the right to copy/download,the right to correct,the right to delete,the privacy right,etc.The rights of personal healthcare data and the implementation requirements of protection are scattered in various regulations and policy documents,and the construction of a complete policy system needs to be strengthened.Conclusion A policy system to promote the sharing and application of healthcare data can be constructed based on the rights and interests of personal healthcare data,which helps to clarify the responsibilities and rights of all parties and protect the rights and interests of patients information.
