公序良俗原则被称为现代民法至高无上的基本原则之一,它构建了一座融汇、沟通人类道德和法律的重要桥梁。根据传统观点,“公序良俗”发端于古罗马法。而事实上,在人类早期法治文明中,体现“公序良俗”的法律精神与相关法律规范即已存在,并较多地体现于借贷契约、利息限制与婚姻家庭法律规范之中。从人类历史早期的美索不达米亚与埃及文明为起点,遍历罗马法、教会法及日耳曼法,直至近代的大陆法系与英美法系,通过剖析它们的“公序良俗”精神及规定,探究“公序良俗”的起源与诞生史话。

The principle of public order and morals is known as one of the supreme basic principles of modern civil law.It builds an important bridge that integrates and communicates human morality and law.According to the traditional view,the principle of public order and morals originated in ancient Roman law.In fact,in the early civilization of the rule of law of mankind,the legal spirit and related legal norms that embody the principle already existed,and they are more embodied in loan contracts,interest restrictions,and legislations of marriage and family.The dissertation will start from the civilizations of Mesopotamia and Egypt in the early human history,traverse Roman law,Canon law,and Germanic law to the modern civil law system and Anglo-American law system,and analyze the spirit and regulations of the principle respectively,to explore its the origin and birth history.
