以飞跃上诉完善我国审级制度的路径分析

构建飞跃上诉制度,既不会对两审造成大的冲击,又可为我国将来之审级制度改革提供经验。飞跃上诉制度有助于提高法官对案件的亲历性,维护法律适用的统一与发展,使具有重大意义案件的审理达到三审的效果。在具体制度设计上,飞跃上诉应当以当事人的合意为启动要件,区分法律问题与事实问题,构建上诉许可制度,明确案件具有重大意义之标准,由最高人民法院巡回法庭负责案件审理。

The construction of a leapfrog appeal system has not only not caused a major impact on hierarchical trail system,but also can provide experience for the reform of China′s future trial level system.Leap-forward appeal system will help improving judges′personal experience of cases,maintain the unity and development of the application of law,and enable the trial of cases of great significance to achieve the effect of third instance.In terms of specific system design,leap appeals should take the consent of the parties as the starting element,distinguish between legal issues and factual issues,build an appeal permit system,clarify the criteria for the case of great significance,and the Circuit Court of the Supreme People′s Court shall be responsible for the trial of the case.
