图书馆数字化作品的著作权保护与TDM的冲突与兼容

The Conflict and Compatibility between the Copyright Protection of Library Digital Works and TDM

为应对信息传播趋势的新发展,图书馆正在不断探索TDM以推动数字化建设,而TDM在运用图书馆数字化作品的过程中版权矛盾十分突出。产权保护固然是著作权法的宗旨,可鼓励传播也是著作权法的制定根基,产权人对其智力成果享有当然的权利,但过度的知识产权保护必定会对图书馆合理利用数字化作品带来不便。

In order to cope with the new development of information transmission trend,libraries are constantly exploring TDM to promote digital construction,but TDM has prominent copyright conflicts in the process of using library digital works.Although the protection of property rights is the purpose of copyright law,encouraging dissemination is also the foundation of the formulation of the copyright law.The property owner has the right to his intellectual achievements,but excessive protection of intellectual property rights will certainly bring inconvenience to the reasonable use of digital works by libraries.
