数字图书馆版权授权制度的检视与完善--著作权延伸性集体管理制度的引入与构建

传统的版权授权机制无法有效应对信息技术所带来的挑战,已不适应如今数字图书馆的发展。著作权延伸性集体管理制度从经济学、法学以及实践的角度都符合一定的逻辑,能够有效解决海量作品的授权许可问题以及孤儿作品、外国作品的合法利用等问题,促使集体管理组织进行内部改革,平衡相关主体的利益冲突。我国可借鉴域外国家的经验对著作权延伸性管理制度进行本土化改造,通过严格限制延伸管理的主体、确立集体管理组织的义务、构建非会员权利保障机制以及完善权属登记制度等配套措施使这一制度更具有可适用性。

The traditional copyright authorization mechanism cannot effectively meet the challenges brought by information technology and is no longer adapt to the development of digital libraries nowadays.The extended collective management system of copyright is logical from the perspectives of economics,law and practice,and can effectively solve the problems of licensing massive works and the legal utilization of orphan works and foreign works,prompting the collective management organizations to carry out internal reforms and balance the conflicting interests of related subjects.China can learn from the experience of foreign countries to localize the system of extended copyright management,and make the system more applicable by strictly limiting the subjects of extended management,establishing the obligations of collective management organizations,constructing a mechanism to protect the rights of non-members and improving the registration system of ownership and other supporting measures.
