普洱茶地理标志规范标注的司法实践与启示

Judicial Practice and Enlightenment of Standardized Labeling of Geographical Indications of Pu’er Tea

随着普洱茶地理标志的影响力扩大,因普洱茶地理标志标注不规范,屡生纠纷。就司法实践看,包括在云南省外生产的茶叶外包装上标注“普洱茶”、在普洱茶外包装上标注普洱茶地理标志不规范、普洱茶类含茶制品在茶叶外包装上标注不规范三类纠纷,建议普洱茶经营者在茶叶外包装上标注“普洱茶”必须符合普洱茶地理标志国家标准,在普洱茶外包装上严格按照普洱茶地理标志国家标准的分类进行标注,普洱茶类含茶制品在外包装上不能标注普洱茶及普洱茶地理标志。

With the expansion of the influence of geographical indications of Pu’er tea,there have been many disputes due to the nonstandard labeling of geographical indications of Pu’er tea.In terms of judicial practice,there are three types of disputes,including the marking of Pu er tea" on the outer package of tea produced outside Yunnan Province,the nonstandard marking of Pu’er tea geographical indications on the outer package of Pu’er tea,and the non-standard marking of Pu’er tea containing products on the outer package of tea.It is suggested that Pu’er tea operators mark "Pu’er tea" on the outer package of tea must comply with the national standards of Pu’er tea geographical indications The outer package of Pu’er tea shall be marked in strict accordance with the classification of national standards for geographical indications of Pu’er tea.Pu’er tea products containing tea cannot be marked in accordance with Pu’er tea and geographical indications of Pu’er tea on the outer package.
