农业生产托管服务主体注册登记的法律风险分析——《市场主体登记管理条例》颁布后的思考

Analysis on Legal Risk of Registration of Agricultural Production Trusteeship Service Principals——Reflections after the Promulgation of Regulations of Administration of Registration of Market Principals

农业生产社会服务是中国实现小农户与现代农业发展有机衔接的有效方式之一,农业生产托管服务主体是其中主要的服务供给方之一。然而,随着《中华人民共和国市场主体登记管理条例》的颁布和实施,部分农业生产托管服务主体由于市场主体地位与登记资格存在争议,可能面临“非法经营”的法律风险和经济风险。基于《山西省农业生产托管服务条例》设定的七类农业生产托管服务主体的登记管理现状、市场主体注册登记资格及其注册登记困境展开全面分析,进一步提出家庭农场和农户自愿组成的合作组织规避法律风险、顺利完成市场主体注册登记的政策建议。最后,对农业生产托管服务主体的未来发展形势进行了初步展望。

Socialized service of agricultural production is one of the effective ways to realize the organic connection between smallholders and modern agricultural development in China,and the agricultural production trusteeship service principals is an important service provider.However,with the promulgation and implementation of the Regulations of the People’s Republic of China on Administration of Registration of Market Principals,some agricultural production trusteeship service principals may face legal and economic risks of"illegal operation"due to disputes over the status of market entities and registration qualifications.Based on the Shanxi Agricultural Production Trusteeship Service Regulation,a comprehensive analysis was carried out on the registration management status,the market principals registration qualifications,and registration difficulties of seven types of agricultural production trusteeship service principals,and some policy suggestions were put forward to avoid legal risks and successfully complete the registration of market principals for family farm and cooperative organization composed of peasant household.Finally,a preliminary prospect for the future development of agricultural production trusteeship service principals was forecasted.
