我国现代环境治理体系的法治路径探讨

The Rule of Law Route of China’s Modern Environmental Governance System

构建现代环境治理体系事关国家总体安全,是依法治国高度关注的领域。聚焦推动生态环境治理体系和治理能力现代化、法治化的目标要求,深化现代环境治理的法治化,以法治方式保障现代环境治理体系的构建,必须坚持以习近平生态文明思想和法治思想为指导,坚持以人民为中心,强化政治引领和法治原则,坚持以“绿水青山就是金山银山”的发展理念构建全过程、全方位的现代环境治理体系,把碳达峰、碳中和工作纳入现代环境体系特别是法治中国建设整体布局之中。坚持法治为民,建立健全碳达峰、碳中和工作法律约束机制,强化战略思维,健全法治,创新制度措施,强化法律执行,用法治的力量确保国家生态文明建设的决策部署落地见效。

The construction of a modern environment governance system concerns the overall security of acountry;it is a field of high attention in the law-based governance of a country.China should focus on thetargets and requirements of promoting the modernization and legalization of eco-environment governancesystem and governance capacity,deepen the legalization of modern environment governance,andsafeguard the construction of modern environment governance system by the rule of law.In so doing,Chinashould take Xi Jinping’s thoughts on eco-civilization and rule of law as the guidance,adopt a people-centered approach,and strengthen political leading and the rule of law principles.The development idea of“clear waters and green mountains are invaluable assets”should be carried out through the overall processof constructing an all-round modern environment governance system.The peak carbon dioxide emissionand carbon neutrality work should be taken into the overall layout of constructing a modern environmentsystem and especially that of constructing the rule of law in China.The country should hold on to the rule oflaw for the people;establish and improve the legal constraint mechanism for the peak carbon dioxideemission and carbon neutrality work;reinforce its strategic thinking;perfect the rule of law,innovate thesystem and measures,and consolidate law enforcement.It should use the power of rule of law to guaranteethe implementation and efficacy of nation’s decision and deployment of eco-civilization construction.
