浙江自贸试验区法定机构试点研究

Research on Statutory Body Piloting in Zhejiang Pilot Free Trade Zone

法定机构源于境外,在各国虽有不同的名称但有着共性。我国自贸试验区引入法定机构,有助于夯实自贸试验区人才基础、增强自贸试验区创新能力、优化自贸试验区营商环境、缓解机构编制需求的压力。目前我国一些自贸试验区在法定机构探索试点过程中也暴露出一些问题。为了规避这些问题,必须从法定机构的试点领域、立法模式、治理架构和运行保障等方面来探索浙江自贸试验区法定机构试点的可行路径。

Statutory bodies originate from abroad,and although they have different names in different countries,they have common characteristics.The introduction of statutory bodies in my country’s pilot free trade zones will help to consolidate the talent base of the pilot free trade zones,enhance their innovation ability,optimize the business environment of the pilot free trade zones,and relieve the pressure on the establishment of institutions.At present,some problems have been exposed in some pilot free trade zones in the process of exploring and piloting statutory bodies.In order to avoid these problems,this paper discusses the feasible paths of pilot statutory bodies in Zhejiang Pilot Free Trade Zone from the aspects of the pilot areas,legislative models,governance structures and operational guarantees of statutory bodies.
