国家与投资者争端解决机制的发展趋势和特点——以ICSID为研究对象

The Development and Characteristics of Investor-State Dispute Settlement:Taking ICSID for Example

新冠疫情席卷全球、部分地区局势动荡,国家与投资者争端频现,以ICSID为例的国家与投资者争端解决机制地位愈来愈重要。ICSID仲裁具有一审终审、秘密性、倾斜保护投资者、扩大管辖权的特点。卡尔沃主义复兴和投资法院的兴盛给以ICSID为例的国家与投资者争端解决机制带来了危机和挑战,也给ICSID改革指明了方向,ICSID改革亟须建立上诉机制、透明化机制、利益平衡机制。中国应当把握机遇,争取国家与投资者争端解决机制更多的话语权,为本国投资者的利益以及实现“走出去”战略保驾护航。

The worldwide epidemic,instability in some areas,and frequent appearance of disputes between countries and investors,investor-state dispute settlement,like ICSID,is becoming increasingly important.ICSID arbitration is wellknown for its final judgment,secrecy,inclined protection for investors and expanded jurisdictions.The resurrection of the Calvo Doctrine and the rise of ICS have brought crises and challenges to ISDS mechanism,like ICSID.But it also points out the direction to the ICSID reform at the same time.ICSID reformation needs the establishment of appeal mechanism,transparent mechanism,and benefit balance mechanism.China should grasp the opportunity and strive for more international power of discourse in the ISDS to protect the interests of Chinese investors and realize the“going out”strategy.
