专利审查高速路的创新发展模式、结构特征及优化策略研究

Patent Prosecution Highway:Innovational Development Mode,Structural Characteristics and Optimization Strategy

专利审查高速路是全球技术创新持续发展、专利国际申请量激增的产物,通过国际合作对审查资源进行合理配置,从而缓解了各国专利审查工作的压力。目前在全球范围内形成了NORMAL PPH、PPH MOTTAINAI和PCT-PPH三种模式,并构建了IP5 PPH和Global PPH多边协议合作网络。通过对于专利审查高速路合作模式的分析,探讨不同技术创新能力的国家对于专利审查国际协作的需求和目标,总结专利审查高速路的特点,为专利审查高速路的优化提供建议,并为我国参与专利审查国际协作提供对策。

Patent Prosecution Highway is the product of the development of global technological innovation and the surge of international patent applications.It can rationally allocate the examination resources through international cooperation to relieve the pressure of patent examination work in countries.At present,three modes of PPH have been set up worldwide,such as NORMAL PPH,PPH MOTTAINAI and PCT-PPH.Base on multilateral protocol cooperation networks,IP5 PPH and Global PPH have been established.By analyzing the coop-eration mode of Patent Prosecution Highway,the needs and goals of countries with different technological innovation capabilities for international cooperation of patent prosecution are discussed.The characteristics of Patent Prosecution Highway is summarized,and suggestions for the optimization of Patent Prosecution Highway is provided with strategy for China to participate in international cooperation of patent examination.
