根本性阻断利益集团“围猎”的制度构建

Institutional Construction to Fundamentally Block the “Entrapping” of Interest Groups

根本性阻断利益集团“围猎”是当下腐败治理的重点与难点,瓦解利益集团“围猎”的作用机制与资源网络,应当从加强权力运行的透明化、构建利益冲突防火墙、增加行贿违法成本以及推进反腐专项合规建设四个层面展开。通过深化权责清单制度及制定“透明性”立法,消除“围猎”机会;通过制定独立的《利益冲突法》及增设利益冲突型腐败犯罪,切断“围猎”网络;通过完善行贿“黑名单”制度,提高行贿罪罚金标准以及建立行贿罪的特别没收制度,遏制“围猎”动机;通过建立一体化的企业反腐合规体系,清除“围猎”污染源。

It is the focus and difficulty of the current corruption governance to fundamentally block the “entrapping” of interest groups.To disintegrate its working mechanism and resource networks,it is essential to strengthen the transparent operation of power,construct a firewall for conflicts of interest,increase the cost of bribery and other illegal activities,and promote anti-corruption special compliance construction.The entrapping opportunities are eliminated by strengthening the powers and responsibilities list system and formulating transparent legislation.The entrapping can be blocked by formulating an independent Law on Conflicts of Interest and by adding crimes of conflicts-of-interest corruption.The entrapping motivation can be curbed by improving the bribery blacklist system,raising the standards of fines for crimes,and establishing a special confiscation system for bribery crimes.The entrapping pollution sources can be eliminated by establishing an integrated corporate anti-corruption compliance system.
