《民法典》的颁布,必定伴随大量过渡法难题。然而,最高人民法院关于民法典时间效力司法解释中的具体规定却不足以全面覆盖所有问题。大部分过渡法问题,仍必需求诸抽象的利益衡量。对于新法追溯效力范围的判断,可以通过区分新法属于“涉及法律事实的规范”抑或“涉及法律状况的规范”,以确定当事人之信赖在时间上的位置。

The promulgation of the Civil Code must be accompanied by numerous issues of transitional law. However, the specific provisions in the judicial interpretation of the Supreme People’s Court on the temporal effect of the Civil Code are not sufficient to cover all the issues.Most transitional law issues still require abstract principle of interest balancing. By distinguishing whether the new law is a “norm involving legal facts” or a “norm involving legal situation”, the parties’ reliance on the timeline can be located to determine the scope of the retroactive effect of the new law.
