“市场因素”在网络游戏直播合理使用认定中的适用性分析 被引量:4

摘要 作为新业态出现的游戏直播,冲击着传统司法认定规则。要回答游戏直播者与游戏直播平台是否实施了著作权侵权行为并承担相应侵权责任这一问题,在对直播行为进行定性后,认定是否构成著作权法意义上的合理使用就成为关键。著作权存在的本意并非要将对于作品形成作出贡献的所有因素进行全面保护,而是保持一定边界。在当前新型游戏直播市场迅速发展的情况下,正确选择保护因素及其适用权重,回归以市场为中心的判断路径,经由判断潜在市场损失程度以及形成相关许可市场的难易程度,妥善地适用合理使用规则,是著作权制度在当前新业态中快速成长并保持活力的重要途径。 As a new form of business,the live game is impacting the traditional judicial identification rules.To answer the question whether the game broadcaster and the game live broadcasting platform have implemented copyright infringement and bear the corresponding infringement liability,it becomes the key to determine whether it constitutes a reasonable use in the sense of copyright law.The original intention of the existence of copyright is not to fully protect all the factors that contribute to the formation of works,but to maintain a certain boundary.With the rapid development of the current live broadcast market of new games,it is an important way for the copyright system to grow rapidly and maintain vitality in the current new business state to correctly select the protective factors and their applicable weights,return to the market-centered judgment path,and properly apply the reasonable use rules by judging the degree of potential market losses and the difficulty of forming the relevant licensing market.
