优化营商环境背景下数据制度的完善

在数字经济时代,完善数据制度是优化营商环境的崭新内涵。我国当前的数据制度尚有不足,不能完全适应优化营商环境的要求,有必要加以完善。基于我国现状与优化营商环境的要求,数据制度的完善应坚持便捷流通、全面保护、数据正义与分类规范四项原则,即促进数据低成本、低阻力的流通,保护数据主体与相关方的合法权益,让每一类主体都能享受到数据的时代红利,针对不同的数据属性与应用场景进行区别规范。在具体制度上,应建立以劳动理论为基础的数据产权制度,各项数据权能有序分离的数据用益制度,场内场外交易相结合的数据流通制度和政府、数据主体和数据行业协同治理的数据安全制度。

In the era of digital economy,improving the data system is a new connotation of optimizing the business environment.Current data system in China is still insufficient and cannot fully meet the requirements of optimizing the business environment,so it is necessary to improve it.Based on the current situation in China and the requirements of optimizing the business environment,the improvement of the data system should adhere to the four principles of convenient circulation,comprehensive protection,data justice and classification norms,namely promoting the circulation of data with low cost and low resistance,protecting the legitimate rights and interests of data subjects and related parties,so that each subject can enjoy the dividends of the era of data,and differentiating and standardizing for different data attributes and application scenarios.In terms of specific systems,a data property rights system based on labor theory,a data benefit system with orderly separation of various data powers,a data circulation system combining on-site and off-site transactions,and a data security system collaboratively governed by the government,the data subjects and the data industry should be established.
