论专利开放共享制度的构建——以开源软件为借鉴

The Construction of Patent Open Sharing System--Taking Open Source Software for Reference

在第四次工业革命和创新驱动发展战略的背景下,知识产权公共领域对于创新活动的促进作用日益凸显。当前,著作权公共领域中的开源软件制度发展较为成熟,并极大促进了人工智能等计算机软件技术的发展。专利和著作权具有一定的相似性,故而可借鉴开源软件制度的经验,及时变革专利公共领域机制,构建专利开放共享制度,以促进专利创新发展。但是,由于专利具有一定程度的自身独特性,专利开放共享制度的设计,需着重从专利开放共享认证机构和认证标准的设立、专利开放共享许可证的差异化制定、创新交流平台和硬件共享平台的构建,以及创新资金支持保障等四个方面予以创新完善,才能最大程度地发挥出制度效能。

In the context of the fourth industrial revolution and the innovation-driven development strategy,the role of the public domain of intellectual property in promoting innovation activities has become increasingly prominent.At present,the development of the open source software system in the public domain of copyright is relatively mature,and it has greatly promoted the development of artificial intelligence and other computer software technologies.Due to the similarity between patents and copyrights,we can learn from the experience of the open source software system to promptly change the patent public domain mechanism and build a patent open sharing system to promote the development of patent innovation.In order to maximize the benefits of the system,however,given that patents have a certain degree of their own uniqueness,the design of the patent open sharing system needs to focus on the innovation and improvement of the establishment of patent open sharing certifi cation bodies and certifi cation standards,the differentiated formulation of patent open sharing licenses,the construction of the innovation exchange platform as well as the hardware sharing platform,and the innovation and capital support.
