深化行刑衔接 打击药品犯罪

Deepen the Connection between Administrative Law Enforcement and the Criminal Justice and Crack down on Drug Crimes

药品行政执法与刑事司法衔接对于打击药品安全违法犯罪活动、保障公众用药安全具有十分重要的作用。经过多年的实践与探索,行刑衔接制度日益完善,但面对日益严峻的药品安全监管形势,药品安全行刑衔接仍然存在着案件移送、立案标准不明确,证据、涉案物品界定处置规则不明晰,监督机制不完善,执法人员协调配合不充分等问题。2020年印发的《安徽省药品行政执法与刑事司法衔接工作规则》进一步完善了药品行刑衔接的制度建设,具有全面、规范、科学、可操作的特点,有助于打击药品安全违法犯罪活动合力的形成。

The connection between drug administrative law enforcement and the criminal justice plays a very important role in combating illegal and criminal activities for drug safety and ensuring drug safety for the people.After years of practices and explorations,the connection system between drug administrative law enforcement and the criminal justice has been improved day by day.However,in the face of the increasingly severe situation of drug safety regulation,there are still some problems in the connection of drug safety execution,such as unclear standards for case transfer and filing,unclear rules for the definition and disposal of evidence and articles involved,imperfect supervision mechanism,insufficient coordination and cooperation of law enforcement personnel and so on.The Working Rules on the Connection between Drug Administrative Law Enforcement and Criminal Justice in Anhui Province issued in 2020 further improves the construction of the connection system between drug execution and punishment,which is comprehensive,standardized,scientific and operable,and helps to form a joint force to crack down on violations and crimes in drug safety.
