知识产权流转体系构建的国际比较与经验借鉴

International Comparison and Experience Reference in the Construction of Intellectual Property Circulation System

知识产权质押融资是国际市场上科技型企业凭借自身知识产权获取资金支持的重要方式,也是我国破解科技型中小企业融资难问题的新途径。当前,我国知识产权流转体系建设的滞后和服务链条不完整成为阻碍知识产权质押业务开展的关键因素。本文系统梳理了美、英、德、日、韩五大经济体的知识产权流转体系在制度构建、平台搭建、运营管理等方面的经验做法,结合国内流转体系建设实践,提出应从完善制度支撑体系、丰富流转平台功能、完善知识产权价值评估体系、推动知识产权产业化四个方面建立适合我国国情的知识产权流转体系。

Intellectual property pledge financing is an important way for scientific and technological enterprises in the international market to obtain financial support by virtue of their intellectual property rights,and it is also a new way for my country to solve the financing difficulties of scientific and technological SMEs.At present,the lag in the construction of my country’s intellectual property transfer system and the incomplete service chain have become key factors hindering the development of intellectual property pledge business.This paper systematically sorts out the experience and practices of the intellectual property transfer systems in the five countries of the United States,Britain,Germany,Japan,and South Korea in terms of system construction,platform construction,and operation management.Combined with the practice of domestic transfer system construction,it is proposed to improve the system support,Enrich the functions of the circulation platform,improve the intellectual property value system,and promote the industrialization of intellectual property rights to establishan intellectual property circulation system suitable for my country’s national conditions.
