《反有组织犯罪法》中刑事程序规则的发展与适用

Development and Application of Criminal Procedure Rules in the Anti-organized Crime Law

虽然《刑事诉讼法》等既有立法、司法规定也涉及有组织犯罪案件的刑事程序问题,但是专门性、系统性不足。《反有组织犯罪法》中的刑事程序规则不仅继承了既有规范,而且创新、完善了不少具体规则,在实践中应准确予以理解、适用。在刑事强制措施与刑罚层面,应注重特殊羁押与执行规则、减刑与假释规则的适用。在财产处置层面,应注重财产查询与紧急措施规则、合法财产处置规则、涉案财产审查和处置规则的适用。在特殊人员保护层面,应注重前置保护规则、证人保护规则、参照保护规则的适用。

Although the Criminal Procedure Law and other existing legislative and judicial provisions also involve criminal procedures in organized crime cases,they are not specific and systematic.The criminal procedure rules in the Anti-organized Crime Law of the People’s Republic of China not only inherit the existing norms,but also innovate and improve many specific rules,which should be accurately understood and applied in practice.As for criminal compulsory measures and punishment,attention should be paid to the application of special custody and execution rules,commutation and parole rules.As for property disposal,attention should be paid to the application of property inquiry and emergency measures rules,lawful property disposal rules,case-involved property review and disposal rules.As for the protection of special personnel,attention should be paid to the application of prepositive protection rules,witness protection rules,and reference protection rules.
