粤港澳大湾区的法律冲突及解决路径探析

Analysis of Legal Conflicts and Solutions in the Guangdong-Hong Kong-Macao Greater Bay Area

基于粤港澳大湾区“一国,两制,三法域”的特有社会背景,其中的法律冲突已经对粤港澳大湾区法治环境的建设与完善造成一定程度的阻碍,同时也对湾区在经济和法律层面的进一步融合与发展产生负面影响。因此,本文将针对粤港澳大湾区的法律冲突从立法和司法角度进行概述,并对冲突解决路径进行探讨。提出立法合作机制、法律人才流动、争端解决机制和商事解决中心的建议,以期能够推动粤港澳大湾区立法合作机制的发展与完善,进而为该区域司法、经济的深度交流与融合奠定坚实的基础。

Based on the unique social background of“one country,two systems,and three legal orders”in the Guangdong-Hong Kong-Macao Greater Bay Area,the legal conflicts have already hindered the establishment and improvement of the legal environment in the Guangdong-Hong Kong-Macao Greater Bay Area and given a negative impact on the further integration and development of economy and laws in the Greater Bay Area.Therefore,this article will give an overview of the legal conflicts in the Guangdong-Hong Kong-Macao Greater Bay Area from the perspectives of legislation and jurisdiction and discuss the conflict solutions.It puts forward suggestions on legislative cooperation mechanisms,legal talent flows,dispute resolution mechanisms and commercial resolution centers to promote the development and improvement of the legislative cooperation mechanisms in the Guangdong-Hong Kong-Macao Greater Bay Area,thereby laying a solid foundation for the in-depth exchanges and integration of the jurisdiction and economy in this area.
