摘要
家庭教育作为一种教育形态,是整个广义教育体系的高质量建设和社会主义现代化强国建设的重要构成,其立法的本质是以国家意志明确家庭教育的重要性并予以规制,以保护和推动其健康发展,服务国家经济社会的重大战略布局。家庭教育的国家立法已有推进,尤其是地方层面的立法探索积累了经验,也反映了一些制度不足和实践诉求,为国家立法提供了现实基础。在理论上,倾向于实体正义的回应型法律范式,是对传统法治秩序的深化和变革,是法律发展的自然延续和理想形态,为我国社会变迁和社会问题导向的家庭教育国家立法提供了行动上的理论解释、实际问题的检视以及路向探索的分析框架。基于回应型法理论的分析框架,结合当前家庭教育地方和国家立法行为的实际,国家立法应在确保家庭教育的科学性、尊重教育规律与未成年人成长规律的前提下,突出家长的主体地位、压实政府的促进职责、发挥学校的引导作用以及优化社会的参与机制。
As a form of education,family education is an important component of the high-quality construction of the entire education system and the construction of a modern socialist country.The essence of its legislation is to clarify and regulate the extreme importance of family education based on the will of the country protect and promote its healthy development and serve the major strategic layout of the country’s economy and society.National legislation for family education has been advanced,especially the experience gained from the exploration of legislation at the local level,which also reflects some system deficiencies and practical demands,and provides a realistic basis for national legislation.In theory,the legal paradigm that tends to substantive justice response is a deepening and transformation of the traditional rule of law and a natural continuation and ideal form of legal development.It provides an action for social changes and social problem resolution in our country.The family education national legislation provides an action the theoretical explanation and examination of practical problems on the above,and the analytical framework for the exploration of the way.Based on the analytical framework of the responsive law theory,combined with the current local and national legislative behaviors of family education,national legislation should highlight the parental status of parents on the premise of ensuring the scientific nature of family education and respecting the laws of education and the growth of minors,compact the government’s promotion responsibilities,give full play to the guiding role of the school,and optimize the social participation mechanisms.
