人工智能司法的应用具有提升笔录、卷宗可靠性,提高审判质效、推动庭审模式转型升级,统一法律适用标准、促进同案同判的功效。与此同时,人工智能司法的发展也面临数据储备先天不足、算法呈现复杂性和隐蔽性、类案识别准确率偏低等技术障碍。本文以当前人工智能应用于司法领域的实践状况为基准,深入探究人工智能技术介入司法可能带来的冲击以及如何应对的问题。在基本立场层面,厘清技术与司法之间的关系,尊重司法价值功效,坚持技术中性理念。在技术保障层面,以算法和数据为着力点,推动人工智能司法交叉学科研究。

The application of artificial intelligence justice can improve the reliability of transcripts and files,improve the trial quality and efficiency,promote the transformation and upgrading of court trial mode,unify the standards of legal application,and promote the efficacy of“like cases being treated alike”.At the same time,the development of artificial intelligence justice is also faced with some technical obstacles,such as congenital deficiency of data reserve,complexity and concealment of algorithm,low accuracy of like case recognition,and so on.Based on the current practice of artificial intelligence applied to the judicial field as a benchmark,this paper deeply explores the possible impact of artificial intelligence technology intervention in the judicial field and how to deal with it.At the level of basic position,we should clarify the relationship between technology and justice,respect the value and efficacy of justice,and adhere to the idea of technology neutrality.At the level of technical support,we should focus on algorithms and data,to promote interdisciplinary research on artificial intelligence justice.
