农村宅基地使用权制度改革路径--以江苏省阜宁县为例

宅基地使用权制度是我国一项重要的土地制度。宅基地一直具有农民居住生存保障的功能。随着经济社会的发展,农民对宅基地不享有处分、收益权能的制度缺陷,导致了大量宅基地和农房闲置,阻碍了农业、农村经济的发展和农民增收。宅基地使用权流转试点的工作遇到了流转途径不畅、退出补偿机制缺失、农民流转土地积极性不高等问题。江苏省阜宁县宅基地自愿有偿转让的模式具有很大的启示意义,即在宅基地使用权改革中要保持宅基地姓“农”的底色,要坚持以市场化的手段调配资源,要健全农村养老保障制度,确保改革在法治的轨道上运行。

Homestead use right system is an important land system in China.Homestead has always played a role in ensuring farmers’ living and survival.With the development of economy and society,farmers do not have the right to dispose of the homestead,the system defects of income,resulting in a large number of homestead and agricultural Housing idle,hindering the development of agriculture,rural economy and farmers’ income.In the experiment of the transfer of the right to the use of homestead,there are some problems,such as the poor transfer way,the lack of compensation mechanism,and the low enthusiasm of farmers.The mode of voluntary and paid transfer of homestead in Funing County,Jiangsu province bringsus a lot of enlightenment.In the reform of homestead use right,we should keep the background color of homestead,adhere to the market-oriented means to allocate resources,improve the rural pension security system,and ensure that the reform runs on the track of the rule of law.
