摘要
《法律援助法》的实施标志着我国积极探索和系统完善法律援助法律规范取得重大成就,并迈入法律援助新时代。深刻理解《法律援助法》,必须准确把握其时代背景、立法定位及其保障功能。具体而言,《法律援助法》是全面依法治国时代重要的立法实践,定位于保护公民法律援助权利的基本法与国家主动保障的国家义务法,同时,作为保障法体系的展开,具有重要的保障功能。
The formal implementation of The Legal Aid Law Since January 1st,2022 marks the significant achievements of China’s active exploration and systematic improvement of legal aid norms,and from now on China has entered a new era of legal aid.A deep understanding of The Legal Aid Law requires an accurate grasp of its historical background,legislative orientation and safeguard function.Specifically,The Legal Aid Law is an important legislative practice of the country in the era of comprehensive rule of law.It is a basic law to protect the rights of citizens’legal aid and a national obligation law actively guaranteed by the state.At the same time,as the development of the security law system,it has the important function of protection.
