数据化侦查理论系统化构建研究

Research on Systematic Construction of Data-Based Investigation Theory

大数据、云计算、人工智能等科学技术的不断进步带来了数据化的时代浪潮,犯罪分子借助科技手段实施新型非接触性犯罪,传统的侦查手段难以适应新型犯罪的侦查取证需要。各地侦查机关在积极开展数据化侦查手段的探索的同时,理论界对于数据化侦查的研究也进行得如火如荼,但是对于数据化侦查的基础概念、规范要求、模式机制等内容缺乏整体的归纳,使得理论研究对数据化侦查的实战支撑力度不足,各地公安机关的实践应用水平参差不齐。为了提升数据化侦查实战能力,强化跨地域的侦查协作,提高证据采信率以期更好地服务于审判活动,对数据化侦查理论系统的构建势在必行。当前,应当着力从三个方面构建数据化侦查理论系统:概念系统、规范系统和分析系统,三大系统的协同配合是提升数据化侦查实战能力的关键。

The development of big data, cloud computing and artificial intelligence has brought the era of data. Criminals use scientific and technological means to implement new types of non-contact crimes, and traditional investigative methods are difficult to adapt. While actively exploring the means of data-based investigation, the investigation authorities have also conducted research in the theoretical circle. Due to the lack of overall induction of basic concepts,normative requirements, mode and mechanism of data-based investigation, theoretical research lacks support for actual combat, and the practical application level of public security organs in different regions is uneven. In order to improve the practical ability of data-based investigation,strengthen cross-regional investigation cooperation and improve the evidence acceptance rate in order to better serve the judicial activities, it is imperative to construct the theoretical system of data-based investigation. We should focus on the construction of conceptual system, normative system and analysis system. Their cooperation is the key to improve the practical ability of databased investigation.
