摘要
网络直播营销模式下的食品营销行为更为复杂,在出现食品安全事件的情况下,追究相关主体的刑事责任需要根据各自法律地位和义务内容进行分析。对于直播营销平台,应考虑以拒不履行信息网络安全管理义务罪或虚假广告罪进行评价;对于销售商家,应考虑以销售不符合安全标准的食品罪或销售有毒、有害食品罪进行评价;对于直播间运营者和直播人员,则主要以虚假广告罪追究刑事责任。在一些情形下,直播间运营者也可能构成销售不符合安全标准的食品罪或销售有毒、有害食品罪。
Marketing of food based on online livestreaming is more complex,so criminal responsibility of related main bodies,in the case of food safety,needs to be analyzed from their legal statuses and duties.The livestreaming platform may commit crimes due to its refusal to fulfill the duty of information and network security management or its false advertising.The sellers may commit the crime of selling food failing safety standards or selling poisonous or harmful food.The operators of live livestreaming studios and livestreaming personnel may commit the crime of false advertising;in some cases,the operators may commit the same crimes as the sellers.
